KSA Cracks Down on Violated TV Game Show Commercials

Recently, a gaming provider was sanctioned by the Dutch Gaming Authority (KSA) for violating rules pertaining to untargeted advertising on a game show. 

The presentation of the sponsorship was crucial. The programme failed to meet the standards since it sponsored a legitimate provider but used the provider's name in conjunction with a fruit machine gaming aspect, which the KSA ruled non-neutral.

The controversial game element was modified to bring it in accordance with the regulatory framework following discussions with the gaming provider and the associated TV programme.

On July 1, 2023, the ban on non-targeted ads took effect. The goal of this rule is to prevent gaming companies from targeting vulnerable populations, such as children and young adults, in their marketing and recruitment efforts. 

It is now officially illegal to advertise on television, radio, in newspapers, or magazines starting from this date. Billboards, bus shelters, and accessible buildings (including arcades, movies, cafes, and casinos) cannot display advertisements either.

The restriction was designed to take into account existing sponsorship contracts, therefore TV programmes can still be sponsored up to July 1, 2024. Contrarily, sports sponsorship will be legal until July 1, 2025.
